David Harris

PRACTICE AREAS

David has a strong reputation in the fields of personal injury, clinical negligence, employment, inquests and regulatory law, representing clients throughout England and Wales.

He specialises in all aspects of personal injury law including industrial disease, severe injury and fatal accidents. In the field of industrial disease, he specialises in asbestos-related injury, work-related cancers, respiratory conditions, dermatitis, RSI, HAVS and NIHL. Away from industrial disease, he has considerable experience of cases involving severe injury including head injuries, spinal injuries, amputations, severe burns, loss of senses, chronic pain disorders and severe psychiatric injury. He is particularly noted for his care and attention on the work involved in drafting schedules of loss and damage and in negotiation.

He is regularly instructed in complex and high value clinical negligence claims. Recent cases have included negligent diabetic care and management in a prison setting (resulting in lower limb amputation), negligently performed colosuspension surgery, misdiagnosis of critical ischaemia (resulting in bilateral lower limb amputation), negligent mistreatment of pressure ulcers and negligent dental treatment.

His work in the field of employment law has tended to be advisory with an emphasis on advising employers and corporations on the National Minimum Wage Regulations. He sits as a Fee Paid Employment Judge in the South West Region.

Inquests form a significant part of his practice. He has recently appeared for families in cases involving fatal accidents at work, deaths in hospital and suicide. He is fully versed with coronial procedures, including Article 2 style inquests, and regularly advises on evidence and procedure at every stage of inquest proceedings.

His regulatory practice is wide. He regularly represents registrants at fitness to practice hearings before the Conduct and Competence Committees of the NMC, the HCPC, the EWC, the CCW and the IET. He has been praised for both his preparation and his advocacy in this specialist area of work.

David has an approachable manner and welcomes informal discussions with solicitors concerning issues that can suddenly arise in the course of litigation that require swift analysis and decision-making. He is able to respond quickly to the demands placed upon those involved in litigation. He is regularly instructed by leading solicitors throughout England and Wales and is experienced in providing tactical advice before, during and after proceedings. His forensic approach is also seen in his advocacy and, in particular, his cross-examination of expert witnesses.

David is listed in The Legal 500 as a leading junior in personal injury and clinical negligence.

He is a Category 4 Prosecutor.

David is a CEDR accredited mediator in civil disputes.
